Well honestly looks like you are both using a template, the major differences I saw were that you are using a CMS and not so sure about them. That and their site is a tad bit sloppier. If you did in fact design the original layout yourself then I apologize for the template comment but that is how it looks to me.

this is most definitely NOT a template site. we are using a cms (CMS Made Simple) http://www.cmsmadesimple.org.
When using any web app, you are confined to it's restrictions. We have this site running on an early version of the CMS.

Just looks like a theme to me. Personally though if a CMS "confined me to its restrictions" I would find another CMS. Which is why I use Textpattern. Just saying what it looks like, but either way they both are using the same stuff.
