They are taking legal action
Well hi,
I have told web designer, your web site is in complete, and is not how i would like it, to cut a long story short, I have paid a deposit , I can not trust him, I do not want the product, they have threatened legal action this morning if i dont pay. Can they do this to me, please help. Steve |

steve the site you posted for us to see looked really nice.* So what has gone wrong between the time you posted that site and now?* I believe you wanted a few edits to the site which is normal.* So how did you go from asking for a few edits, to being so upset with them?

The images he used where large, there was no room for the text i had prepared, I was told by someone here the site is just images and there is no code for search engine to see the site. the home page requests customers to go to hints and tips page , there is no hints and tips page. if this is put right, I will buy it and have done and hopefully i could sort it out here, I have no more funds if I have to pay these people. and now if i pay up will they deliver the site in tact, if they dont then im left with the decision of taking legal action , please advice

Hang on, just to be clear, are you saying that you don't want to pay them any more until they put right the things that need putting right, but they are saying they won't do any more on it till you pay them? Is that the situation? If so, then without any kind of contract or agreement between you there is no easy solution that I can see. I also can't see how either they or you could take legal action with no evidence of what was agreed.

I have been designing for clients a long time. I ask for a deposit. When I receive the deposit, I begin to put together examples of website. Each one is a mock up. Meaning What they gave you must have been the very first mockup which with a few changes would be quite fine for your business. Quote:
We adviced you to get a contract so if you did not, you will have no legal leg to stand on. The contract would have answered all your questions. How many pages and I entitled to, how many edits can I make to the initial layout, is SEO services involved, When the site would be completed, etc. Your best bet now is to be NICE to them, stop acting like they are cheating you and find out "nicely" what it would take to finish this site. Threatening legal action on them, is not going to endear you to them. I can only imagine how they are feeling on their end. They have submitted a site to you in good faith of being paid in full for their services. Now you are threatening not to pay. I realize I do not know all the details because you have been quite vague. Let them do their job, they are the professionals, they obviously know what they are doing because the site got good reviews in the critique forum. yea no contract...no written agreement...so technically you can walk away without the site anything but you'd lose your £100 deposit and need to get someone else to create your site...without an agreement there is no proof that you agreed to pay so I don't see theyd have a case.
That is one option. The other option is that you carry on arguing with him...although by the sounds of it hes not gonna budge! it was a nice looking site...from what I can remember it wasn't brilliantly coded...i just tried to look but seems they have passworded it now so public can't see it. |

rather than them telling u u have to pay now....
why not phone em and agree what needs to be done, when it needs to be done by, what changes nee dmaking etc. and get it all in a written agreement. Then you can go on with your project |

Maybe you owe them a mid point payment fee?* Some companies take a deposit, mid point payment and then a final payment.
I think there is more going on then you are telling us.* Or there has been some nasty emails going back and forth because this sounds really bizarre. Most companies will go the extra mile for their clients.* A happy client is worth their weight in gold because it means good word of mouth advertising.* They probably locked the site because they saw it up on this forum as an unfinished piece of work.* |

Yes, and as Lchad says, be nice, without a contract, nice is all you've got. I'm sure you can find some way through to suit both of you - good luck with getting it resolved

Yeah but they haven't got a leg to stand on either and if I understand it is them threatening legal action not Steve. I would personally tell them to screw themselves. Cut your losses and find someone else. If they aren't doing all they can to satisfy their customers then they aren't doing their job. Web design is not just a bout drawing pretty pictures.

I wouldn't want to be without my $100 deposit though. So at this point, I think it's best to work it out.
You are right Pete, without a contract they have no legs either. They might have to learn a lesson the hard way as well. Sounds tricky but nice will get you everywhere in life... Steve seems really nice so I have confidence that he can get this solved! |

No contract...HUGE mistake. Actually, if Steve doesn't play really nice, he looses money and site, period. AT this point the site designer has all the power. This is where the fine art of negotiation comes into play. You have got to figure out how you can make this a win-win because right now you are not in a good place. Good luck and if we can offer any suggestions, let us know.

up date, I now have a copy of terms and conditions which states, there is a cooling off period, and that there can be negotiations on how much I pay for the work they have done, as I am no wiz at building web site's lol i have drafted in a very very helpful person to sort this mess out who happens to be very good at his job. you have all helped to keep the blood presure down , thankyou, steve, |
